Tesla vs. Xi'an's Ms. Li Appellate Court Decision and Vehicle Appraisal Results

TapTechNews August 5th news, recently, the appellate court decision has come out in the case of Tesla suing Ms. Li from Xi'an (one of the core members of the Shanghai Auto Show incident) for infringement of reputation rights. The amount that Ms. Li should compensate Tesla has been adjusted from 2,000 yuan in the first instance to 70,000 yuan. Ms. Li's appeal reasons are not tenable, and the court does not accept Ms. Li's appeal claims.

At the same time, the judicial appraisal institution entrusted by the court conducted an appraisal on the vehicle involved, and the appraisal opinion is: Tesla vehicle braking system is normal, effective and without faults, conforming to relevant technical standards.

Previously, Ms. Zhang from Anyang who stood on the roof at the Shanghai Auto Show has been determined to have infringed on Tesla's reputation rights, and self-media people like Feng and Big Eyes have also been successively ordered by the court to compensate for their rumors and smears against Tesla.

According to TapTechNews' previous report, in November 2023, in the case of Tesla suing the Xi'an female car owner in the Shanghai Auto Show incident for infringement of reputation rights, the court made a first-instance judgment, determining that the reputation infringement liability of Ms. Li from Xi'an was established, and she must publicly apologize to Tesla and compensate for economic losses and rights protection expenses of 2,000 yuan, while also bearing the vehicle appraisal fee.

The defendant, Ms. Li from Xi'an, had a traffic accident while driving a Tesla in March 2021. On April 19, 2021, Ms. Li from Xi'an and Ms. Zhang from Anyang, both wearing clothes with the words brake failure, appeared at the Tesla booth at the Shanghai Auto Show. On that day, Ms. Zhang from Anyang was administratively detained by the Qingpu Branch of the Shanghai Municipal Public Security Bureau for disturbing public order, and Ms. Li from Xi'an was given an administrative warning.
