Shanghai Conducts Special Rectification for Personal Information Protection in Coffee Consumption Scenario

Recently, after the review and inspection by the Shanghai Cyberspace Administration, it was found that Pacific Coffee, Luckin Coffee, COSTA COFFEE, MStand, Nowwa Coffee, and One Garden and other 6 enterprises still have problems with incomplete rectification, reflecting that some enterprises still have not truly and effectively implemented the relevant requirements of the Personal Information Protection Law. On the afternoon of August 6th, the Shanghai Cyberspace Administration, in conjunction with the Municipal Market Supervision Bureau, legally interviewed the heads of the above coffee enterprises.

In the interview, the Shanghai Cyberspace Administration seriously criticized the 6 enterprises for having missing, false or incomplete privacy policies, forced or frequently induced collection of precise location information, forced or induced membership joining, and failure to provide the option to turn off targeted push and other illegal and non-compliant problems. It required enterprises to earnestly fulfill their obligations for personal information protection and implement the principles of minimum necessity and notification-consent in personal information processing without compromise, and truly achieve clear and complete privacy policies and legal and compliant collection of personal information. The Municipal Market Supervision Bureau requires enterprises to take effective measures to protect the legitimate rights and interests of consumers, implement the relevant requirements of the Consumer Rights and Interests Protection Law and the Regulations for the Implementation of the Consumer Rights and Interests Protection Law, fulfill the main responsibility of enterprises for the protection of consumers' personal information, and earnestly do a good job in legal and standardized business operations.

The relevant responsible persons of the Shanghai Cyberspace Administration and the Municipal Market Supervision Bureau pointed out that the coffee culture is the unique charm of Shanghai as an international cultural metropolis, and the coffee consumption demand has been widely integrated into people's work, life, study, and leisure and other scenarios in Shanghai. In the fragrance of coffee, it is not only a feast for the citizens' sense of smell and taste, but also an experience of urban safety, trustworthiness, and assured consumption. In view of the situation that some enterprises have weak awareness of laws and regulations in the field of personal information protection, ineffective problem rectification, and insufficient fulfillment of obligations, the urban and district-level Cyberspace Administration and the Market Supervision Department will jointly organize a follow-up review on-site inspection of personal information protection. For enterprises that do not correct after repeated teachings and have serious problems, they will be subject to case handling and public exposure.

The heads of 24 chain coffee enterprises such as Starbucks, Luckin Coffee, MannerCoffee, McCafé, Tims Tianhao Coffee, Nowwa Coffee, COSTA COFFEE, MStand, SeesawCoffee, niiicecafé, Peet'sCoffee, and Cotti Coffee participated, involving more than 3600 stores in the city, requiring coffee enterprises to improve their awareness of personal information protection and fulfill their obligations for personal information protection, and strictly follow the principle of minimum necessity and notification-consent in personal information collection.
