China's Lingang New Area Releases First Batch of General Data Lists for Data Cross-Border Scenarios

TapTechNews May 18th news, the Administrative Committee of the Lingang New Area of the China (Shanghai) Pilot Free Trade Zone released the first batch of national general data lists for data cross-border scenarios and the supporting operation guidelines for the list.

The first batch of general data lists includes three fields such as intelligent connected vehicles, public offering funds, and biomedicine, involving 11 scenarios such as intelligent connected vehicle cross-border production and manufacturing, medical clinical trials and research and development, and fund market research information sharing, which are specifically divided into 64 data categories and more than 600 fields.

Taking the field of intelligent connected vehicles as an example, the general data list specifically involves 4 scenarios such as cross-border production and manufacturing, global R & D and testing, after-sales service, and used car global trade, 23 data categories such as R & D and design data and after-sales service records, and 158 data fields such as vehicle chassis drawings and product oil clay models.

According to the requirements, data processors can apply to the Administrative Committee of the Lingang New Area for consultation on the data fields under each data category of the general data list, and carry out data cross-border flow in accordance with the management requirements of the Operation Guidelines for General Data List of Data Cross-Border Flow in the Lingang New Area of the China (Shanghai) Pilot Free Trade Zone (Trial). The trial period of the list is one year from the date of release, and after the trial ends, adjustments and updates will be made according to the actual situation.

The newly released documents show that in the one-year pilot project, enterprises registered in the Lingang Area of the Shanghai Free Trade Zone where the Tesla Shanghai factory is located can transfer the data included in the list overseas without further security assessment.

In April this year, the Cyberspace Administration of Shanghai and the Administrative Committee of the Lingang New Area jointly established the Lingang New Area Data Cross-Border Service Center as the physical window for the implementation of the general data list operation to provide enterprises with the whole process services such as consultation, guidance, preliminary review, and filing for enterprise data exit. TapTechNews found that the Lingang New Area has also simultaneously formulated the supporting operation guidelines of the list to help enterprises apply the general data list to carry out data cross-border flow efficiently and compliantly.

The general data list shows that in the cross-border production and manufacturing scenario, it includes data such as production management, parts and materials procurement, inventory management, quality management, remanufacturing of faulty parts, and logistics supply chain that are indeed required to cross-border during the cross-border production and manufacturing process of automobiles. In the global R & D and testing scenario, it includes enterprise internal data such as product design, product testing, and R & D management that are indeed required to cross-border during the product development and ite ration of automobiles. In the after-sales service scenario, it includes data such as basic vehicle information, after-sales process records, fault analysis, and after-sales service reports that are indeed required to cross-border during the after-sales service process. In the used car global trade scenario, it includes data such as vehicle information, maintenance and insurance that are indeed required to cross-border to support vehicle pricing and vehicle sales.

Yin Dan, the chief information officer of SAIC Volkswagen Automobile Co., Ltd., said that the automotive data list, through the scenario-based approach, clarifies which data fields can exit the country under different scenarios, solves the confusion of enterprises about the data exit fields, provides guidance for enterprises in the practical operation and implementation level of automotive data cross-border circulation, and clarifies the compliance path.
