Shanghai Enacts Amendment to Non-motorized Vehicle Safety Management Regulations

TapTechNews reported on May 14th that according to the Office of the Standing Committee of the Shanghai People's Congress, the decision to amend the 'Shanghai Non-motorized Vehicle Safety Management Regulations' (referred to as the 'Amendment Decision') was passed on May 10, 2024, and will be implemented from June 1, 2024. The main changes in this revision are to prohibit carrying electric bicycles or their batteries into elevator cars, strengthen the source governance of 'splicing and modification' of electric bicycles, increase the promotion of the construction of charging facilities, and strengthen the safety management of passenger ferries carrying electric bicycles. The Amendment Decision specifies that the city and district people's governments should increase investment in the construction of non-motor vehicle parking lots and charging facilities in residential communities, promote the construction of parking lots and charging facilities according to local conditions, and better meet residents' needs for regular charging. In order to adapt to the changing requirements of electric bicycle safety management, the Amendment Decision emphasizes the management requirements of electric bicycle batteries, guides and regulates the carrying, placement, and charging of batteries by the public in multiple clauses, and focuses on reducing safety hazards caused by batteries. The Amendment Decision adds requirements for the safety management of passenger ferries carrying electric bicycles, including the provision of fire-fighting facilities and strengthening safety inspection of electric bicycles, in order to reduce the risk of carriage and improve emergency response capabilities. It also clarifies that those carrying electric bicycles on passenger ferries must comply with the management requirements established by the operating units. To prevent the fire hazards caused by illegal charging behavior, the Amendment Decision specifies that illegal charging in shared parts of buildings, fire exits, and crowded places is prohibited; legal responsibilities are set for private wiring and sockets for charging electric bicycles and batteries; and indoor charging in residential buildings and carrying electric bicycles or their batteries into elevator cars are prohibited, with corresponding legal responsibilities. In order to further leverage the advantages of collective prevention and control, the Amendment Decision stipulates that managers of non-motor vehicle parking facilities and property service enterprises, homeowner self-management organizations, etc., shall discourage and stop illegal charging behaviors in accordance with management rules or property service contracts; those who do not comply should report to law enforcement agencies. In addition, the Amendment Decision also provides guidance on the administrative, criminal, and civil liabilities that may be incurred for illegal parking and charging causing fires; it specifies that procuratorial organs should explore the prosecution of public interest litigation on relevant accidents and hidden dangers according to the law. To better prevent and control the safety risks of electric bicycles, the Amendment Decision specifies legal responsibilities for engaging in commercial activities of assembly, installation, and modification of non-motor vehicles or selling assembled, installed, or modified non-motor vehicles.
