81 E-commerce Platforms Sign the Self-Discipline Convention for IP Protection

On September 21, TapTechNews reported that on September 20, the State Administration for Market Regulation held a centralized signing event for the Self-Discipline Convention for E-commerce Platform Operators to Improve the Level of Intellectual Property Protection (hereinafter referred to as the Self-Discipline Convention by TapTechNews). Eighty-one platforms such as Taotian Group, Pinduoduo, Douyin, Tencent, Xiaohongshu, JD.com, and Dewu signed the convention.

The Self-Discipline Convention mainly refines the platform complaint rules for intellectual property rights holders, requiring the platform to establish a convenient and unobstructed rights protection Q&A channel, timely review complaint evidence, and uniformly announce it on the rights protection page.

The Self-Discipline Convention has a total of ten articles, which clearly regulate from aspects such as establishing an access management system, unclogging the channels for accepting infringement, assisting in the investigation of infringement cases, establishing a credit evaluation mechanism, and improving the classified handling system, which helps to improve the ability of e-commerce platform operators to prevent intellectual property risks and handle disputes, and earnestly fulfill the obligation of intellectual property protection.

The Self-Discipline Convention was initiated and promoted by the State Administration for Market Regulation and is a commitment document voluntarily signed and self-executed by various e-commerce platforms. This document clearly specifies the specific requirements for e-commerce platforms to fulfill the obligation of intellectual property protection and enhances the operability of the relevant provisions of the Trademark Law of the People's Republic of China and the E-commerce Law of the People's Republic of China. The vast majority of e-commerce platforms should, in contrast to the committed matters, further improve the platform's system rules, refine the work process, and take more practical and effective measures to protect intellectual property. Market supervision departments at all levels should strengthen guidance and supervision to ensure the effective implementation of the convention's content.
