The decision of Musk's withdrawal came just one day before the judge's originally scheduled hearing to dismiss the lawsuit request of OpenAI. One day earlier, Musk also publicly criticized OpenAI and its new partnership with Apple, saying that if Apple integrates OpenAI's technology into the operating system level of iPhones and Macs, he will ban his company from using Apple devices and made some other threats.

His lawsuit alleged that OpenAI violated the agreement reached with Musk and other founding members, who all promised to build OpenAI as a non-profit organization and keep its technology open source.

However, Nilay Patel of TheVerge pointed out that there are some problems with Musk's case: Musk directly accused OpenAI of violating a non-existent contract. This contract simply doesn't exist! The complaint mentioned the 'founding agreement', but didn't attach the agreement as an annex, and the claim for breach of contract acknowledges that the 'founding agreement' is basically just a vague consensus reached through some emails.

TapTechNews noticed that OpenAI denied his accusations shortly after Musk filed the lawsuit, stating that Musk was trying to gain the absolute control of the company by merging OpenAI with Tesla. The company also said that there is basically no agreement with Musk at all.

Last year, Musk founded an artificial intelligence company named xAI, and the company created the GrokAI chatbot, which can be obtained through the XPremium subscription. This start-up has raised $6 billion in funds from investors for the expensive chips needed by its artificial intelligence system.
