Student in Hohhot Allegedly Tampered with Classmate's College Entrance Examination Volunteer, Faces Criminal Charges

TapTechNews August 16th news, according to the news on the evening of August 15th from the Qingcheng Police of the Hohhot Municipal Public Security Bureau in Inner Mongolia Autonomous Region (TapTechNews note: Qingcheng is an alias for Hohhot City). Recently, the police branch of the Xincheng District Public Security Sub-bureau received a report that the college entrance examination volunteer was maliciously tampered with by others. Because it is the first case in the autonomous region, the police branch immediately organized a case analysis meeting for this case, combined with the precedents of similar cases across the country for analysis, to figure out the context of the case and discuss and study the tactics and methods for such new types of cybercrime cases.

The police branch relied on its own technical advantages to conduct analysis and judgment, and found that Wang XX, a student at a certain vocational school in Hohhot suspected of obtaining the account and password of his classmate's college entrance examination volunteer application by covert means, and took the opportunity to tamper with his college entrance examination volunteer.

On August 14th, the police branch filed a case for investigation of this case and interrogated the criminal suspect. The criminal suspect Wang XX confessed to his criminal facts and has constituted the crime of destroying the computer system.

At present, the public security organ has legally taken criminal detention measures against the criminal suspect Wang XX.

According to Article 286 of the Criminal Law of the People's Republic of China, [the crime of destroying the computer information system] refers to:

Violating state regulations, deleting, modifying, adding, or interfering with the functions of a computer information system, resulting in the inability of the computer information system to operate normally, and if the consequences are serious, the offender shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention; if the consequences are especially serious, the offender shall be sentenced to fixed-term imprisonment of not less than five years.

Violating state regulations, deleting, modifying, adding operations to the data and application programs stored, processed, or transmitted in a computer information system, and if the consequences are serious, the offender shall be punished in accordance with the provisions of the preceding paragraph.

Intentionally creating and spreading computer viruses and other destructive programs, affecting the normal operation of the computer system, and if the consequences are serious, the offender shall be punished in accordance with the provisions of the first paragraph.

If a unit commits any of the crimes mentioned in the preceding three paragraphs, a fine shall be imposed on the unit, and the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the provisions of the first paragraph.
